,I CASE # ,.~ I I I I I REQUEST FOR A CONDITIONAL USE PERMIT TO GRADE SOILS; CASE OF RONALD KABAT By: City Engineer Steve Jankowski and Zoning Administrator Sylvia Frolik Background: On July 15, 1998, Ronald Kabat submitted an application to the City for a conditional use permit to grade soils on Lot 4, Block 5, Fox Ridge Estates. The following items are enclosed: 1) Site location map 2) Three-sheet project proposal 3) Draft Planning Commission public hearing and regular meeting minutes dated August 4, 1998 4) Proposed findings of fact 5) Proposed conditional use permit Notification: State statute requires notification of the public hearing to property owners within 350 feet of the subject property. Staff attempted to notify property owners within 500 feet of the subject property of the public heating date. Observations: The applicant is proposing to mine soils fi.om the pond and dirt mound on the site to raise the elevation of the property between the house and the pond to make the backyard more useable. The project will enlarge the southeast comer of the pond by about 40 feet and increase the depth of the pond fi.om approximately 6 inches to 3 feet. The project does not include any importing or exporting of soils fi.om the site. The site has been reviewed and the wetland has been delineated. No filling is proposed for any wetland areas. The Planning Commission conducted a public hearing on August 4 and one neighbor was present in support of Mr. Kabat's request. Recommendation: The Planning Commission recommends approval of the request for a grading permit.
