I
I
I

I

CASE

REQUEST FOR A CONDITIONAL USE PERMIT FOR A PRIVATE DOG
KENNEL TO MAINTAIN MORE THAN TWO ADULT DOGS ON A PARCEL;
CASE OF MARK AND DONI HEULE
By: Zoning Administrator Sylvia Frolik

Background:

On June 1, 1998 the City received an application from Mark and Doni Heule for a
conditional use permit to maintain a maximum of eight (8) adult dogs on the property at
7262 162nd Lane N.W. The following items are enclosed for your information:

a)
b)
c)

d)
e)

Site location map
Site Plan and letter of application
Draft Planning Cominission public hearing and meeting minutes dated
July 7, 1998
Proposed findings of fact
Proposed conditional use permit

Notification:

In accordance with State Statute, Staff attempted to notify all property owners within 350
feet of the subject property of the request and public hearing.

Observations:

The subject property is approximately 3.9 acres in size and is zoned R-1 Rural
Residential. The applicants have provided a site plan and text which indicates that they
raise show dogs that reside in the home and are only let outdoors for exercise in a 2 acre
fenced yard. The dogs are not outdoors when no one is home, most of them have been
surgically debarked, and generally there are only 6 on the property at any given time as
two of the eight are usually with the handler in Texas. In addition to the existing fenced
exercise yard, Mark and Doni proposed to install a privacy fence along the northwest
comer and east line of the existing fence line to provide screening in addition to
containment from the public road and adjacent neighbors to the east. The applicants are a
veterinarian and veterinarian technician by profession and because of that, they state that
they are very sensitive to responsible pet care.

The Planning Commission conducted a public hearing on July 7 and the adjacent
neighbors to the east (Douglas and Ann Gihl) expressed opposition to the request.
