Councilmember introduced the following resolution and moved for its <br />adoption: <br /> <br />RESOLUTION NO. 98-08- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT FOR <br />PRIVATE DOG KENNEL TO MAINTAIN MORE THAN TWO DOGS ON A PARCEL <br />OF LAND. <br /> <br /> 'WHEREAS, the Ramsey City Council adopted Resolution No. 98-08- adopting <br />Findings of Fact # for this use and herein approves the Conditional Use Permit subject to <br />the following conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On , 1998, a Conditional Use Permit ("Permit") was issued by the City of <br />Ramsey ("City") to Douglas W. and Evelyn M. Behrens ("Permittee") for a private dog kennel to <br />maintain more than two adult dogs on the property generally known as 5759 153rd Avenue NW <br />and legally described as follows: <br /> <br />The west 165 feet of the Southeast Quarter of the Northeast Quarter of Section 23, <br />Township 32, Range 25, Anoka County, Minnesota, subject to road easement. <br /> <br />("Subject Property"). <br /> <br />This Permit is issued pursuant to Section 9.03.04 of the Ramsey City Code. The conditions of <br />this Permit are as follows: <br /> <br />This Permit shall remain in effect so long as the conditions imposed herein are complied <br />with. Should the Permittee die or move to a new location, the existing Permit shall be <br />automatically terminated, except that a surviving child, residing at the same address, or the <br />subsequent property owner, desiring to continue the Permit, shall submit written notice to <br />that effect to the Administrator and the Council may authorize continuation of the Permit <br />without further hearing. <br /> <br />2. This Permit shall allow for the maintenance of a maximum of fifteen (15) adult dogs (over 3 <br /> months in age) and puppies (under 3 months in age) on the Subject Property. <br /> <br />o <br /> <br />Any outdoor kennel structure or doghouses that may be constructed on the Subject Property <br />for the purpose of housing dogs for time increments exceeding 8 consecutive hours, shall <br />maintain a minimum setback from side property lines equal to that of the principal structure. <br /> <br /> <br />
