Absent: None. <br /> <br />Case #1: <br /> <br />Request for a Conditional Use Permit for a Private Dog Kennel to Maintain <br />More than Two Adult Dogs on a Parcel; Case of Douglas Behrens <br /> <br />Mr. Behrens stated the proposed permit requires a 75 foot setback from side property lines for <br />any kennels constructed. The lot is only 165 feet wide so that leaves a narrow 15 foot window <br />for kennel and exercise area. <br /> <br />Zoning Administrator Frolik inquired if 50 feet is a more reasonable"amount. She stated the 75 <br />foot requirement wa~ intended to apply to any structure that would provide protection from the <br />elements for eight consecutive hours or more, not exercise runs. <br /> <br />Motion by Commissioner Anderson, seconded by Commissioner Deemer, to recommend that City <br />Council adopt Findings of Fact #1 - 13 relating to Douglas and Evelyn Behrens' request for a <br />conditional use permit for a private dog kennel for a maximum of 15 dogs. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Anderson, Deemer, Jensen, <br />LaDue, Terry, and Wivoda. Voting No: None. Absent: None. <br /> <br />Motion by Commissioner Terry, seconded by Commissioner Wivoda, to recommend that City <br />Council adopt Findings of Fact #14 as follows: That the proposed use will not adversely impact <br />traffic in the area. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Terry, Wivoda, Anderson, <br />Deemer, Jensen, and LaDue. Voting No: None. Absent: None. <br /> <br />Motion by Commissioner Deemer, seconded by Commissioner Terry, to recommend that 'City <br />Council adopt Findings of Fact #15 - 20 in the affirmative. <br /> <br />Motion Carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Anderson, <br />Jensen, LaDue, and Wivoda. Voting No: None. Absent: None. <br /> <br />Motion by Commissioner Deemer, seconded by Commissioner Wivoda, that the City Council <br />adopt the amended Findings of Fact relating to Douglas and Evelyn Behrens' request for a <br />conditional use permit for a private dog kennel for a maximum of 15 dogs. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Wivoda, Anderson, <br />Jensen, LaDue, and Terry. Voting No: None. Absent: None. <br /> <br />Motion by Commissioner Deemer, seconded by Commissioner Anderson, that item #3 of the <br />permit be changed from 75 feet to 50 feet and modified to state: Any outdoor kennel structure or <br />doghouses that may be constructed on the Subject Property for the purpose of housing dogs for <br /> <br />Planning Commission/August 4, 1998 <br /> Page 4 of I3 <br /> <br /> <br />
