The City shall acquire 120 feet of right-of-way plus all temporaxy easements necessary for the construction of Industry Boulevard on an alignment acceptable to Anoka County.' The City shall limit access to the proposed Industry Boulevard by limiting tn six (6) accesses tn Industry Boulevard between CSAH 56 (Ramsey Boulevard) and CSAH 83 (Armstrong Boulevard). For the purpose of this provision, a cross street will constitute two (2) access points, one on each side of Industry Boulevard. III. COSTS: A. The contract costs of the work, or if the work is not contracted the cost of all labor, materials, normal engineering costs, and equipment rental required to complete the work, shall constitute the actual "cometion costs" and shall be so referred to herein. "Esr/mated costs" are good faith projections of the costs which will be incurred for this project. Actual costs may vary and those will be the costs for which the City will be responsible. The estimated cost oft. he total project is $718,262.10. The County will not pay for the following: 1. The City will pay for 100% of the cost of new sidewalks installed on the project. The esfim~cd cost to the City is zero (0). 2. The City will pay 100% of the' hydram relocation and gat~ box adjustment, wa~r, and sewer construction. The estimated City's cost of these items is $1,270.02. 3. The City will pay 100% of the cost of bituminous path. The City's estimated costs for bituminous path pavement is $61,921.00. 4. The City shall pay for all right-of-way as well as all costs of right-of-way acquisition. 5. The City will pay for 100% of the'Wetland mitigation. The cost of the wetland mitigation is estimated at $8,672.87. 6. The total estimated cost to the City for the construction of the project is $71,863.89. The City's participation in engineering will be at a rate of 8% of its designated share. The estimated cost to the City for engineering is $5,749.11. C. The total estimated cost to the City for the project is $77,613.00. D. Upon award of the contract, the City shall pay to the County, upon written demand by the County, 95% of its portion of the construction costs of the project estimated at $73,732.35. The City's share of the cost of the projeot shall include only construction and engineering expenses and does not include administrative expenses incurred by the County. E. Upon final completion of the project, the City's share of the construction cost will be based upon actual construction costs. If necessary, adjustments to the initial 95% charged will be made in the form of credit or additional charges tot he City's share. Also, the remaining 5% of the City's portion of the construction costs shall be pa/d. This Agreement shall continue until (1) terminated as provided hereinafter, or (2) until the construction provided for herein is completed and payment provided for herein is made, whichever of (1) or (2) shall first occur. 2
