I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> ! <br /> I <br /> I <br /> I <br />! <br />I <br />I <br /> <br />Case//8: <br /> <br />Request for a Conditional Use Permit to Grade and Export Soils; Case of <br />Gerald Bauer <br /> <br />City Engineer Jankowski explained a flat plateau ran through the center of the 65 acres and <br />dropped off to the north. The proposal is to grade the site down to the 875 contour with a minor <br />south to north grade of 0.10%. The biggest concern with grading is the expense of' storm sewer <br />when the property develops. <br /> <br />City Engineer Jankowski stated there is a low area with a swale running from west to east at an <br />elevation of 868. He recommended the applicant be required to have a 0.05% grade from the 875 <br />contour back and be allowed to utilize the sump area with a high pofnt through the center of' the <br />site. This would result in less material being taken from the site. He indicated discussing the <br />0.05% grade with Mr. Bauer and Mr. Bauer agreed. <br /> <br />Motion by Commissioner Deemer, seconded by Commissioner Terry, to recommend that City <br />Council approve with the minimum grade of 0.05% as recommended by the City Engineer. <br /> <br />Further Discussion: Commissioner Wivoda questioned if it is premature to recommend approval <br />of' the conditional use permit when there are no findings of fact. Zoning Administrator Frolik <br />stated staff can prepare the standard grading permit findings and the Planning Commission could <br />direct the City Engineer to supervise the findings. <br /> <br />Motion withdrawn by Commissioner Deemer. <br /> <br />Motion by Commissioner Deemer, seconded by Commissioner Wivoda, to direct City staff to <br />draft findings in the affirmative and recommend that City Council adopt same. <br /> <br />Further Discussion: Commissioner Jensen inquired if there is a timeframe for the conditional use <br />permit. Zoning Administrator Frolik stated the conditional use permit would be valid for three <br />years. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Wivoda, Jensen, <br />LaDue, and Terry. Voting No: Commissioner Anderson. Absent: None. <br /> <br />Motion by Commissioner Deemer, seconded by Commissioner Terry, that based on the findings <br />of fact, staff draft a grading permit and recommend approval to the City Council. <br /> <br />Motion Carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Jensen, <br />LaDue, and Wivoda. Voting No: Commissioner Anderson.
