I I I I I I I I I I I I I I I Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #98-08- RESOLUTION APPROVING 3RD AND FINAL PAYMENT TO W.B. MILLER, INC. FOR IMPROVEMENT PROJECT #97-23 (BUSINESS PARK 95 7TH ADDITION .... STREETS, STORM SEWER, SANITARY SEWER, AND WATERMAIb0 WHEREAS, the Ramsey City Council approved this project on August 12, 1997; and WHEREAS, on April 14, 1998, the Ramsey City Council adopted Resolution #98-04- 058 awarding the bid to W.B. Miller, Inc. in the amount of $256,534.50 for the construction of streets, storm sewer, sanitary sewer and watermain in Business Park 95 7th Addition (Improvement Project #97-23); and WHEREAS, Change Order No. 1 has been approved in the amount of $6,210.00; and WHEREAS, previous payments have been made to W.B. Miller, Inc. for Improvement Project #97-23 amounting to $210,969.63; and WHEREAS, City Engineer Steve Jankowski has inspected the completed work and recommends final payment to W.B. Miller, Inc. in the amount of $59,446.30. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as foIlows: 1) That the City Council hereby authorizes final payment to W.B. Miller for the construction of streets, storm sewer, sanitary sewer and watermain in Business Park 95 7th Addition (Improvement Project #97-23) in the amount of $59,446.30. 2) That the City Council hereby accepts the project and authorizes the Mayor or City Administrator to sign the release form for this payment. 3) That the total amount of this payment is not included in resolutions approving payment of bills for the month of August 1998. 4) That the City of Ramsey Finance Department be provided a signed copy of this resolution. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember , and upon vote being taken thereon, the following voted in favor thereof: and the following voted against the same:
