I <br /> I <br /> I <br />I <br />'1 <br /> I <br /> <br /> I <br /> I <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />CASE #: <br /> <br />APPROVE FINAL SETTLEMENT OF MPRS LAWSUIT <br />By: Linda Waite Smith, Administrative Services Manager <br /> <br />Background: <br /> <br />Most of the issues in the MPRS lawsuit have been resolved, but one remains open. The court, <br />under the auspices of Judge Solem who is now retired, required ongoing reporting on all testing <br />procedures used in the selection of police officers for the next five years. <br /> <br />Attorneys representing the defendant cities have negotiated a $15,000 proposed settlement with <br />the plaintiffs' attorneys. In return, the plaintiffs' attorneys will join the defendants' attorneys in <br />requesting that Judge Solem's replacement dismiss the case. <br /> <br />It is highly likely but not absolutely certain the court will agree to the joint request. If it does <br />not, the $15,000 will not be paid. <br /> <br />The MPRS executive committee recommends the settlement and suggests that member cities be <br />assessed based on their percentage of participation in MPRS. Ramsey's portion would be $282. <br /> <br />In a letter received yesterday, attorney Charlie LeFevere states: <br /> ...the cities have a good chance of succeeding in the appeal of this case. However, <br /> success is not certain, and if the appeal is unsuccessful, the cost of further proceedings in <br /> District Court, together with the commitment of city staff resources necessary to submit <br /> necessary reports, would quickly exceed the amount proposed as settlement. <br /> <br />Staff agrees with Mr. LeFevere's assessment. <br />Committee Action: 0,/ ~.0~.~0 ~J [~ /c~ / ~d <br />Motion to recommend that Council adopt the attached resolution concurring with the proposed <br />negotiated settlement of the MPRS lawsuit, and <br /> <br />Motion to recommend that Council authorize payment of Ramsey's share of the settlement, <br />which amounts to $282.00 to be taken fi.om the budget line item for legal expenses. <br /> <br />Reviewed By: <br /> <br />Copies also distributed to: <br /> <br />City Administrator <br />City Attorney <br />Finance Officer <br />Administrative Services Manager <br /> <br />PC 9/22/98 <br /> <br /> <br />
