CASE # <br /> <br />CONSIDER RESTORATION OF DRAINAGE EASEMENT ON <br />LOTS 1 AND 2, BLOCK 2, PONDVALE ESTATES 2ND ADDITION <br />By: Steve Jankowski, City Engineer <br /> <br />Background: <br /> <br />At the September 16, 1998 Road and Bridge Committee meeting, the issue of the partial filling <br />of a drainage and utility easement on Lots 1 and 2, Block 2, Pondvale Estates 2nd Addition was <br />addressed. These two lots, along with Lot 3, are owned by Jennifer and Todd Asmussen. They <br />appeared at the September 8 City Council meeting during Citizen Input to state that the filling of <br />the lots was an attempt to stabilize a chronic erosion problem in the depression that was <br />constructed within the easement. The City Engineer pointed out that the purpose of the easement <br />was to contain storm water coming off of Helium Street and to prevent discharge of this water <br />onto the adjoining property over which we have no easement. <br /> <br />The Road and Bridge Committee suggested that a policy be formulated to address the <br />responsibilities associated with such easements, and also directed that the City rectify this <br />particular situation to the satisfaction of the property owners. <br /> <br />To accomplish this staff is recommending that the fill be removed and the depression regraded to <br />its pre-filled contours, that four inches of topsoil be spread over the side slopes, and that sod be <br />placed on the side slopes to control erosion and provide an aesthetic appearance. The cost of this <br />work is estimated to be $3,500. <br /> <br />Financing: <br /> <br />The financing for this work would be taken from the Public Improvement Revolving (PIR) Fund. <br /> <br />Recommendation: <br /> <br />It was the recommendation of the Road and Bridge Committee to restore and stabilize the <br />drainage and utility easement on Lots 1 and 2, Block 2, Pondvale Estates. <br /> <br />Council Action: <br /> <br />Motion to authorize the restoration of the drainage and utility easement on Lots 1 and 2, Block 2, <br />Pondvale Estates, allocating $3,500 from the PIR Fund to facilitate the restoration. <br /> <br />Reviewed by: <br /> <br />Copies distributed to: <br /> <br />City Administrator <br />Director of Public Works <br />Finance Officer <br /> <br />Jennifer and Todd Asmussen <br /> <br />CC: 10/13/98 <br /> <br /> <br />
