CASE

REQUEST FOR A CONDITIONAL USE PERMIT TO EXCEED THE MAXIMUM
SINGLE ACCESSORY STRUCTURE SIZE RESTRICTIONS;
CASE OF SCOTT LEBAKKEN
By: Zoning Administrator Sylvia Frolik

Background:

On October 20, 1998, the City received an application from Scott Lebakken for a conditional use
permit to exceed the maximum single accessory structure size restrictions on his property at
14100 Germanium Street N.W. The following items are enclosed for your information:

a)
b)
c)

d)
e)

Site location map
Site Plan and letter of application
Draft Planning Commission public hearing and regular meeting minutes dated
11/2/98
Proposed findings of fact
Proposed conditional use p6rmit

Notification:

In accordance with State Statute, Staff attempted to notify property owners within 350 feet of the
subject property of the request for a conditional use permit.

Observations:

The subject property is .9 acres in size and is restricted to a total of 1,488 square feet of garage
and accessory building space. In addition, there is a 624 square foot size restriction on any single
accessory structure. Scott currently has a 528 square foot attached garage. Mr. Lebakken is
proposing to construct a 960 square foot accessory building in which to store his personal
recreational equipment. The addition of the proposed 960 square foot accessory building
complies with the parameters for total garage space allowed on the subject property, but it will
exceed the maximum single building size restriction by 336 square feet.

Mr. Lebakken states that in order to comply with City Code single building size restrictions, he
would have to build a 624 square foot detached garage and increase the size of his attached
garage by 336 square feet. If he puts an addition on his attached garage, it will prohibit access to
his detached garage.

The City has approved overages in building sizes in the past.

The Planning Commission conducted a public hearing on November 2 and there were no verbal
or written comments submitted.
