Case#I/ <br /> <br /> CONSIDER EMINENT DOMAIN AUTHORITY TO <br />UTILIZE A LAND PARCEL FOR WETLAND MITIGATION <br />By: Steve Jankowski, City Engineer <br /> <br />Background: <br /> <br />A tract of land which includes ownership by Connexus Energy,_. the City of Ramsey and Waste <br />Management Inc., exists in the general area northwest of the intersection of C.R. #116 and <br />Sunwood Drive N.W. A development plan has been prepared which combines these three <br />properties in order to accommodate a feasible economic development of this land which is <br />bounded by wetland, and the above named roadways. A sketch of this is attached. <br /> <br />The parcel owned by Waste Management Inc. is only 0.9 acres in size and too small to be <br />developed by itself. It would also require an access directly out on C.R. #116 which is <br />undesirable. The plan for the development of this area will require wetland filling. Approval has <br />been secured from the WMO for this filling, however wetland mitigation is required. The <br />subject parcel would provide an opporttmity to facilitate a portion of that mitigation. <br /> <br />Waste Management Inc. has recently been acquired by another company, and regulations <br />prohibit the new owner from divesting of any acquired assets for a period of two years. Hence, it <br />is not possible for a negotiated sale of this property. Therefore, acquisition through eminent <br />domain remains as the only possibility of obtaining this property for developing in 1999. <br /> <br />Financing: <br /> <br />It is proposed the financing for the acquisition of this property comes from TIF funds. <br /> <br />Recommendation: <br /> <br />Staff recommends passing of an eminent domain resolution and filing the necessary legal <br />documents to begin acquisition of this parcel. · .~h <br />Action:.o~.g 7 ~'~ <br />Moiton to adopt Resolution #98-11~xx~ utilizing eminent domain proceedings for the <br />acquisition of parcel part of PIN 27-32-25-13-0001. <br /> <br />Reviewed by: <br /> <br />City Attorney <br />City Administrator <br />Finance Officer <br />Director of Public Works <br /> <br />CC: 11/24/98 <br /> <br /> <br />
