case <br /> <br />SENIOR CITIZEN HOUSIN~ LAND ACQUISITION ISSUES <br /> <br />By: William K. ~oodrich, City Attorney <br /> <br />Background: <br /> <br />As the Council is aware, the city is in the process of acquiring by <br />eminent domain, land for the construction of the Senior Citizen <br />Housing project which project is to be located on a portion of the <br />Kenneth Laws property lying west of Highway 47, south of County <br />Road 5 and east of Dysprosium Street and is identified as PIN: 25- <br />32-25-31-0008. The parcel to be acquired is approximately 3.9 <br />acres in size. The City's appraiser has determined the value of <br />the property to be $252,000.00. The condemnation process requires <br />that the City Council approve this appraisal value and therefore <br />the attached resolution has been prepared for that purpose. <br /> <br />Because the title to the property is to be eventually transferred <br />to the Anoka County HRA, the.City must adopt an ordinance for this <br />transfer purpose per the City Charter. This ordinance procedure <br />takes approximately 45 days and therefore in order to commence <br />construction immediately after the City obtains title to the <br />property, Anoka County is requesting that we amend the Joint Powers <br />Agreement between the city and the Anoka County HRA stating that we <br />will transfer title as soon as possible under the provisions of the <br />City Charter. Attached is a copy of the proposed Joint Powers <br />Agreement Amendment as prepared by the Anoka County Attorney's <br />office. <br /> <br />Enclosure: <br /> <br />me <br /> <br />Resolution approving appraisal of value. <br />Amendment to Joint Powers Agreement. <br /> <br />Recommendation: <br /> <br />Staff recommends approving the $252,000.00 appraisal of value and <br />agreeing to amend the Joint Powers Agreement. <br /> <br />Council Action: <br /> <br />Motion to adopt resolution 98-12- which is a resolution <br />approving the appraisal of value in the amount of $252,000.00 for <br />acquisition of the Senior Citizen Housing parcel located west of <br />Highway 47, south of County Road 5 and east of Dysprosium Street. <br /> <br />Motion to approve the amendment to the Joint Powers Agreement with <br />the Anoka County HRA and directing the Mayor and City Administrator <br />to execute the same on behalf of the City. <br /> <br />Review Checklist: <br /> <br />City Administrator <br /> <br /> <br />
