R. CONCRETE DESIGN; <br />CASE OF RICK BURNHAM <br /> By: Cindy Sherman, Community Development Director <br /> <br />Background: <br /> <br />Rick Burnham is seeking site plan review to develop a 12,960 square foot office/warehouse <br />building on Armstrong Boulevard (CSAH 83). The development is proposed on lot 1, Block 1, <br />HY-10 Ramsey 2nd Addition. The following items are enclosed: <br /> <br />a) Site location map <br />b) Site plan <br /> <br />Notification: <br /> <br />Site plans are not subject to a public hearing. <br /> <br />Observations: <br /> <br />The property is located in the area which was recently included in a development moratorium. <br />The moratorium became effective on September 28. This application was submitted on <br />September 25 prior to the moratorium becoming effective. However, the moratorium language <br />states that the City will not approve any applications while the moratorium is in effect unless an <br />exception to the moratorium is granted. Staff does not believe an exception is warranted in this <br />case. <br /> <br />The ordinance outlines the criteria that must be met in order to grant an exception to the <br />moratorium. One of the criteria is "that the proposed exception will be harmonious with and in <br />accordance with the specific objectives of the City's existing comprehensive Plan and will not <br />adversely affect the planning process for adoption of amendments to the Comprehensive Plan <br />above described." <br /> <br />The draft Comprehensive Plan identifies this parcel as a potential area for land use change and it <br />is located outside of the Urban Service Area. The proposed policies in the Plan provide that <br />urban services be available for commercial and industrial developments. Any approvals on this <br />site would not be in keeping with the intent of the moratorium which is to protect the planning <br />process. Since the application' is not consistent with the draft land use plan or policies it would <br />not be subject to the exception provision of the moratorium. <br /> <br />The Planning Commission did not review the site plan details but would like an oppommity to <br />review the plans should the application move forward at this time or in the future. <br /> <br /> <br />
