APPLICABILITY The moratorium adopted by this Ordinance applies only to that certain real property within the City legally described as follows: That part of Section 24, Township 32, Range 25, Anoka County, Minnesota described as follows: Government Lots 2 and 3; and the Southwest Quarter of the Northwest Quarter, except the South 660.0 feet of the West 181.5 feet; and the Southeast Quarter of the Northwest Quarter, except the West 1206.0 feet and except the South 660.0 feet; and EXCEPT those portions platted as REILLEY ESTATES and REILLEY ESTATES 3P'I) ADDITION. SECTION 6. UNDUE HARDSHIP EXCEPTIONS The City Council may grant an exception to the provisions of this Ordinance when, in its opinion, undue hardship may result from strict compliance. In granting an exception, the City Council shall prescribe any conditions that it deems necessary to or desirable for the protection of the public interest. No exception shall be granted unless the City Council finds: That there are special circumstances or conditions affecting said property such that the strict application of the provisions of this Moratorium Ordinance would deprive the petitioner of the reasonable use of petitioner's land. That the exception is necessary for the preservation and enjoyment of a substantial property right of the petitioner. o That the granting of the exception will not be detrimental to the public welfare or injurious to other property in the area in which the property is situated. That the proposed exception will be harmonious with and in accordance with the specific objectives of the City's existing Comprehensive Plan and will not adversely affect the planning process for adoption of amendments to the Comprehensive Plan above described. That the proposed use/subdivision will be consistent with the intent and purpose of this Ordinance.
