I <br /> I <br /> I <br /> I <br />I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />or platting shall be accepted or acted upon by the City, except as may be permitted by <br />Section 6. below. <br /> <br />SECTION 5. APPLICABILITY <br /> <br />The moratorium adopted by this Ordinance applies only to that certain real property <br />within the City legally described as follows: <br /> <br />That part of Section 24, Township 32, Range 25, Anoka County, <br />Minnesota described as follows: <br /> <br />Government Lots 2 and 3; and the Southwest Quarter of the Northwest <br />Quarter, except the South 660.0 feet of the West 181.5 feet; and the <br />Southeast Quarter of the Northwest Quarter, except the West 1206.0 feet <br />and except the South 660.0 feet; and EXCEPT those portions platted as <br />REILLEY ESTATES and REILLEY ESTATES 3P'I) ADDITION. <br /> <br />SECTION 6. UNDUE HARDSHIP EXCEPTIONS <br /> <br />The City Council may grant an exception to the provisions of this Ordinance when, in its <br />opinion, undue hardship may result from strict compliance. In granting an exception, the <br />City Council shall prescribe any conditions that it deems necessary to or desirable for the <br />protection of the public interest. No exception shall be granted unless the City Council <br />finds: <br /> <br />That there are special circumstances or conditions affecting said property <br />such that the strict application of the provisions of this Moratorium <br />Ordinance would deprive the petitioner of the reasonable use of <br />petitioner's land. <br /> <br />That the exception is necessary for the preservation and enjoyment of a <br />substantial property right of the petitioner. <br /> <br />o <br /> <br />That the granting of the exception will not be detrimental to the public <br />welfare or injurious to other property in the area in which the property is <br />situated. <br /> <br />That the proposed exception will be harmonious with and in accordance <br />with the specific objectives of the City's existing Comprehensive Plan and <br />will not adversely affect the planning process for adoption of amendments <br />to the Comprehensive Plan above described. <br /> <br />That the proposed use/subdivision will be consistent with the intent and <br />purpose of this Ordinance. <br /> <br /> <br />
