Also, the current code allows residents whose private garage is less than 864 square feet
the option of applying to the maximum accessory structure size the difference of the
private garage square footage from 864 square feet. The draft ordinance addresses two of
staff's concerns relating to this practice by eliminating that option. First, it confuses and
erodes the purpose of setting a maximum single accessory structure size. Second, these
very large pole buildings seem to foster illegal business activities on residential property.

Lastly, the draft ordinance states that right of ways shall not be included when calculating
the parcel size. However, this may be in conflict, or may not be clearly stated in other
sections of the City Code and should be corrected with the curre.nt project to clean up
Chapter 9.

Recommendation:

City Staffreeommends approval of the proposed ordinance.

Commission Action:

Motion to:
Recommend that City Council adopt an ordinance to amend Chapter 9.11.02, Subdiv. 12
(Accessory Buildings) of the City Code to allow metal accessory structures on properties
two acres and greater in size, and add design standards for such metal accessory
structures on parcels two to five acres in size.

Reviewed by:

Zoning Administrator
City Attorney

PC: 02/03/98
