CASE <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO ESTABLISH ACCESSORY <br />OUTDOOR RECREATIONAL USES TO A RESTAURANT AND BAR; <br />CASE OF DIAMONDS SPORTS BAR & GRILL, INC. " <br />By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />The City has received an application for a conditional use permit from Diamonds Sports Bar & <br />Grill, Inc., to establish outdoor recreational uses including softball, volleyball and broomball as <br />an accessory use to a restaurant and bar proposed to be developed on Outlot C in Tooth Acres. <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map <br />Site plan <br />Transmittal from the Anoka County Highway Department dated March 2, 1998 <br />Copy of conditional use permit issued to Superbowl for a similar use <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />Notification: <br /> <br />State law requires notification to properties within 350 feet of the boundaries of the subject <br />property. Staff attempted to notify properties within 4,000 feet of the request for conditional use <br />permit. <br /> <br />Observations: <br /> <br />The applicants are proposing to develop a sports bar and restaurant that will include 3 outdoor <br />softball fields and 5 volley ball courts for use in the summer and 3 broomball courts for winter <br />use. <br /> <br />The property is properly zoned for eating and drinking establishments. The City has made it a <br />practice to require conditional use permits for outdoor recreational activities in the commercial <br />districts. The surrounding parcels to the east and south are part of the Mississippi West regional <br />park, the property to the west is also zoned commercial, and the property is bounded on the north <br />by Hwy. gl0. There is approximately 1,000 feet between the nearest point of the subject <br />property and the Mississippi River; however, the property is not included in the Critical River <br />Overlay District. <br /> <br />There is approximately 1,100 feet between the nearest residential neighborhood and the proposed <br />facility. In researching a similar use in the City of Andover, which has an 800 foot separation <br />from the nearest residential neighborhood, Staff has been informed that ballfield lighting and <br />noise created by patrons at play are the potential nuisances.
