REQUEST FOR A CONDITIONAL USE PERMIT FOR A PRIVATE DOG KENNEL TO MAINTAIN MORE THAN TWO ADULT DOGS ON A PARCEL; CASE OF PHILLIP AND FRANCES TEETZEL By: Zoning Administrator Sylvia Frolik Background: On May 6, 1998 the City received an application from Phillip and Frances Teetzel for a conditional use permit to maintain a maximum of four adult dogs on the property at 16405 Quartz Street N.W. The following items are enclosed for your information: a) b) c) d) Notification: Site location map Site Plan Proposed findings of fact Proposed conditional use permit In accordance with State Statute, Staff attempted to notify all property owners within 350 feet of the subject property of the request and public hearing. Observations: The subject property is approximately 1 acre in size and is zoned R-1 Rural Residential. The applicants have provided a site plan which indicates that the east and south yards are to be fenced in to provide a secured exercise area for the dogs. It should be noted that City Code prohibits anything but decorative fences in front yards. Consequently, the Applicants may have to modify their site plan so that the fencing does not extend closer to the front property line than the front wall of the home. The dogs are raised as indoor dogs and will sleep indoors. However, in the event the applicants decide to build an outdoor kennel structure, the permit has been drafted to require that it be at least 75 feet from any common property lines with adjacent neighbors. Similar requests have been granted in the past. Recommendation: City Staff recommends approval of the request. Commission Action: Motion to recommend that City Council adopt Findings of Fact relating to Phillip and Frances Teetzel's request for a conditional use permit for a private dog kennel of more than 2 adult dogs.
