CASE

REQUEST FOR MINOR COMPREHENSIVE PLAN AMENDMENT
TO MODIFY THE METROPOLITAN URBAN SERVICE AREA BOUNDARY;
CASE OF DOLPHIN REAL ESTATE PARTNERSHIP
By: Zoning Administrator Sylvia Frolik

Background:

As you may recall, Council approved the site plan for a Burger King facility in the
northwest quadrant of Hwy. #10 and Ram~ey Blvd. on August 12, 1997. The site is just
outside the Metropolitan Urban Service Area boundary and was proposed to be served
with an on-site septic system and well. Subsequent to the site plan approval, the
developer (Greg Dolphin of Dolphin Real Estate Partnership) has determined through
experiences in another community that on-site septic systems for fast food restaurants are
problematic and costly. Consequently, on June 9 the Ramsey City Council received Mr.
Dolphin's request for a MUSA boundary modification to include their 3 acre site in order
that the facility may be serviced with municipal water and sanitary sewer

Observations:

The request constitutes a minor comprehensive plan amendment. Accordingly, on June 9
the City Council directed City Staff and the Planning Commission to process the request
brough proper procedures. A public hearing in front of the Planning Commission.

On June 9, 1998, the Council received legal opinion that the Charter provision requiring a
public referendum for MUSA boundary expansions is unlawful. As a result, the City
'Attorney has advised the Planning Commission to consider this proposed MUSA
boundary modification from a planning per, speetive only.

Recommendation:

Approve the proposed amendment to the MUSA boundary.

Commission Action:

Motion to recommend City Council approve/deny the proposed minor comprehensive
plan amendment to modify the MUSA boundary to include the proposed Burger King
site.

Review Checklist:
City Administrator
City Attorney

PC: 06/22/98
