Councilmember <br />adoption: <br /> <br />introduced the following resolution and moved for its <br /> <br />RESOLUTION #98-07- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE' OF A CONDITIONAL USE PERMIT <br />FOR THE CONSTRUCTION AND OPERATION OF A PERSONAL <br />COMMUNICATION SERVICE (PCS) TOWER AND DECLARING TERMS OF SAME <br /> <br /> WHEREAS, U.S. WEST WIRELESS has properly applied for a conditional use permit <br />to construct and operate a telecommunications tower on a 30' x 40' section (Site) of the property <br />legally described as follows: <br /> <br />That part of the Southwest Quarter of th. e Northwest Quarter of Section 19, Township 32, <br />Range 25, lying southwesterly of the Southwesterly Right-of-Way Line of Burlington <br />Northern Railroad, westerly of the Westerly Line of Outlot D, Northfork, easterly of the <br />most Easterly Line of Lot 2, Block 1, Ramsey Commercial Park, northerly of the <br />Northerly Right-of-Way Line of U.S. Trunk Highway No. 10, 52 and 169 and <br />southeasterly of the following described line: Commencing at the most northerly comer <br />of Outlot D, Northfork; thence north 39 degrees 01 minutes 26 seconds west along said <br />Southwesterly Right-of-Way Line 340 feet to the point of beginning; thence south 50 <br />degrees 58 minutes 34 seconds west 162 feet; thence southwesterly along a tangential <br />curve concave to the southeast, a radius of 1887.83 feet, a central angle of 12 degrees 21 <br />minutes 17 seconds a distance of 407.07 feet and thereby terminating; except road; <br />subject to easement of record. <br /> <br />("Subject Property") <br /> <br /> WHEREAS, the Planning Commission met on July 7, 1998, conducted the public <br />hearing and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact # , a conditional use permit for a 120 foot monopole and <br />related equipment cabinets is hereby granted to U.S. West and Carrol and Frances Welte, <br />hereinafter referred to as "Permittee". <br /> <br />This permit is perpetual in its duration so long as the terms imposed herein are complied <br />with. <br /> <br />The development of the Site shall be in accordance with site plan sheets Z-l, Z-2, Z-3 and <br />Z-5 dated June 1 and 2, 1998, and sheet Z-4 (Landscape Plan) revision date , and <br />written support materials prepared by U.S. West. <br /> <br />35' <br /> <br /> <br />
