cas ; # ! <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR A PRIVATE DOG <br />KENNEL TO MAINTAIN MORE THAN TWO ADULT DOGS ON A PARCEL; <br />CASE OF MARK AND DON/HEULE <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On June 1, 1998 the City received an application from Mark and Doni Heule for a <br />conditional use permit to maintain a maximum of eight (8) adult dogs on the property at <br />7262 162nd Lane N.W. The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Site Plan and letter of application <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff attempted to notify all property owners within 350 <br />feet of the subject property of the request and public hearing. <br /> <br />Observations: <br /> <br />The subject property is approximately 3.9 acres in size and is zoned R-1 Rural <br />Residential. The applicants have provided a site plan and text which indicates that they <br />raise show dogs that reside in the home and are only let outdoors for exercise in a 2 acre <br />fenced yard. The dogs are not outdoors when no one is home, most of them have been <br />surgically debarked, and generally there are only 6 on the property at any given time as <br />two of the eight are usually with the handler in Texas. The applicants are a veterinarian <br />and veterinarian technician by profession and because of that, they state that they are very <br />sensitive to responsible pet care. <br /> <br />Similar requests have been granted in the past. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the request. <br /> <br />Commission Action: <br /> <br />Motion to recommend that City Council adopt Findings of Fact relating to Mark and <br />Doni Heule's request for a conditional use permit for a private dog kennel for a maximum <br />of 8 dogs. <br /> <br />I <br /> <br /> <br />
