CASE <br /> <br /> REQUEST FOR A CONDITIONAL USE PERMIT <br /> TO GRADE AND EXPORT SOILS; CASE OF MICHAEL LEBLANC <br /> By: City Engineer Steve Jankowski <br /> <br />Background: <br /> <br />On May 29, 1998, Mr. Michael LeBlanc submitted an application to the City for a conditional <br />use permit to grade and export approximately 50,000 to 60,000 yards of soil from Lots 1, 2 and 3 <br />oi"Pineview Estates 2nd Addition. <br /> <br />The following items are enclosed: <br /> <br />a) Site location map <br />b) One sheet grading plan <br />c) Proposed findings of fact <br />d) Proposed conditional use permit <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff attempted to notify property owners within 700 feet of the subject <br />property of the public hearing date. <br /> <br />Observations: <br /> <br />The applicant has indicated that the ultimate deposition of the subject property will be the <br />development of single family homes in accordance with the covenants for Pineview Estates 2nd <br />Addition. <br /> <br />It is unlikely that the proposed silt fence alone will be adequate to prevent erosion into the <br />wetland. It is recommended that the permit require the construction of a sump area upstream of <br />the silt fence, having a storage volume capable of storing a one-inch storm. This sump should <br />have an outlet control device approved by the City Engineer. <br /> <br />The finished grade slopes on the west and south boundary of the site are proposed to be 25%. <br />Section 9.4.18, subd. 11, of the City Code states that no finished slope shall exceed 12%. These <br />slopes should be flattened to reach a maximum slope of 12%. <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of the request for a grading permit with revisions to finished <br />slopes and erosion control as described. <br /> <br /> <br />
