Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #98-07- A RESOLUTION ADOPTING FINDING OF FACT # RELATING TO A REQUEST FROM NORTH FORK, INC. FOR A CONDITIONAL USE PERMIT TO GRADE AND IMPORT SOILS WHEREAS, the City of Ramsey received an application from North Fork, Inc. for a conditional use permit to grade and/or import soils from the property legally described as follows: Lots 7 and 8, Block 4, Northfork, Anoka County, Minnesota (hereinafter referred to as "Site A"). -and- Lots 5, 6, 7 and 8, Block 3, Northfork Links Addition, Anoka County, Minnesota (hereinafter referred to as "Site B"). NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follow, s: That on June 23, 1998, North Fork, Inc., hereinafter referred to as "Applicant", applied for a conditional use permit to grade soils on Site A and grade and import soils on Site B. That the Applicant appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.04 of the City Code on July 7, 1998, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. That the Applicant is proposing to grade an area of two (2) acres to a mean depth of two (2) feet on Site A. o That the Applicant is proposing to grade and add fill to the front yards of Lots 5, 6 and 8 on Site B, in accordance with an expired conditional use permit issued on July 11, 1995 and Grading Plan prepared by Ulteig Engineering dated June 29, 1995. The depth of fill will be from one to two feet and will not raise the existing building pad elevation. That the Applicant states that the amount of fill imported to Site B will be less than 400 yards. 6. That the proposed source of fill material for Site B will be from Block 2 ofltasca Shores. That the proposed haul route for importing soils to Site B will be Andrie Court N.W. and Andrie Street N.W. 8. That no fill materials, except topsoil for restoration, are proposed to be imported to Site A. 9. That no blasting will be employed in the grading activity at either site.
