Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #98-07- <br /> <br />RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT # AND DECLARING TERMS OF PERMIT TO <br />GRADE AND IMPORT SOILS <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution No. 98-07-.... adopting Findings <br />of Fact #~ for this use and herein approves the Conditional Use Permit subject to the following <br />conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On ., 1998 a Conditional Use Permit ("CLIP") was issued by the City of Ramsey ("City") <br />to North Fork, Inc. ("Permit Holder") for grading operations on the property legally described as <br />follows: <br /> <br />Lots 7 and 8, Block 4, Northfork, Anoka County, Minnesota <br />(hereinafter referred to as "Site A"). <br />-and- <br />Lots 5, 6, 7 and 8, Block 3, Northfork Links Addition, Anoka County, Minnesota <br />(hereinafter referred to as "Site B"). <br /> <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br /> <br />This permit shall expire three (3) years from the date of commencement of operations and the <br />Permit Holder shall be responsible for providing the City with at least 48 hours advance notice <br />of the date of commencement of operations. This Permit shall allow for the grading of Site A <br />in accordance with the Grading Plan prepared by Ulteig Engineering and dated June 30, 1998, <br />and the grading and importing of soils to Site B in accordance with the Grading Plan prepared <br />by Ulteig Engineer, Inc., dated June 29, 1995. <br /> <br />o <br /> <br />The ingress and egress to Site B shall be from Andrie Street N.W. The Permit Holder shall <br />promptly sweep the street in front of the access to site B at the end of each day in which <br />hauling takes place. The Permit Holder shall be responsible for removing any spilled material <br />fi.om the public roads immediately upon direction to do so by the City Engineer. Failure to do <br />so shall be cause for the City Engineer to order the necessary work to be done and billed to the <br />Permit Holder. <br /> <br />All grading operations for Site A shall be conducted in accordance with the plan prepared by <br />Ulteig Engineering and dated June 30, 1998. All grading operations for Site B shall be <br />conducted in accordance with the one (1) sheet Grading Plan prepared by Ulteig <br /> <br /> <br />
