'l <br /> I <br /> I <br /> i <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br /> CASE # ~ <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR A PRIVATE DOG <br />KENNEL TO MAINTAIN MORE THAN TWO ADULT DOGS ON A PARCEL; <br />CASE OF DOUGLAS AND EVELYN BEHRENS <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On July 20, 1998 the City received an application from Douglas and Evelyn Behrens for a <br />conditional use permit to maintain a maximum of fifteen (15) adult dogs and puppies on <br />the property at 5759 153rd Avenue N.W. The following items are enclosed for your <br />information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Letter of Application and Fencing Plan <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />Notification: <br /> <br />State Statute requires notification of the public hearing to property owners within 350 feet <br />of the subject property; Staff attempted to notify all property owners within 500 feet. <br /> <br />Observations: <br /> <br />Douglas and Evelyn Behren assumed ownership of the subject property at the end of July. <br />The subject property is approximately 5 acres in size and is zoned R-1 Rural Residential. <br />The surrounding parcels are zoned R-1 Rural Residential and B-1 Business. The <br />applicants breed and show Shiba Inus, a small companion dog. They generally have 4 or <br />5 adult dogs at any given time and average 2 litters a year with each litter producing 3-4 <br />puppies. The puppies are offered for sale at the age of 8 weeks; the City defines an adult <br />dog as one that is 3 months or 12 weeks of age. Therefore, in order to maintain their 4 or <br />5 adult dogs plus one or two litters of puppies that might be ~over 12 weeks in age before <br />they are sold, the Applicants are requesting a permit to keep a maximum of 15 adult dogs <br />and puppies on the property. The applicants indicate that the dogs are kept indoors <br />overnight and they have submitted a fencing plan to identify how the dogs will be <br />restricted to the property when they are outdoors. <br /> <br />Similar requests have been granted in the past. <br /> <br /> <br />
