TEMPE CODE <br /> <br /> (c) In the event that an application is denied by the board, the board shall reserve the right <br />to refuse to consider another application on the same matter for a period of one year. An <br />appticant desirJ~ng to re-Japply less than one year from the date app'earing on the previous <br />appticafion shall submit a letter requesting the board to reconsider its denial. Any request for <br />reconsideration must be based upon new grounds not covered in the previous application. Such <br />request will be co~tsidered by the board during a post-session, and the applicant will be informed <br />oi; the 'board's decision by letten If the reconsideration is approved, the applicant may then re- <br />apply £or the request, filing a new application with alt attachments and paying the applicable fee. <br /> <br /> (d) The commtmJi¥ development director may approve a sign, a change to the color scheme <br />of an existing building, a building addition or structure, or a revised landscape plan based upon <br />the following criteria: <br /> <br />(1) Building addition or skmcture: <br /> <br />a. It is an addition to a existing building or it is an accessory structure of one <br /> thousand (I,000) square feet or less; <br />b. It is a minor revision to a building or structure previously approved by the board; <br />¢~ The addition or accessory does not substantially alter the appearance of the site <br /> as viewed from off the site; and <br />d. It is an addition, or accessory structure that is visually integrated and <br /> m'chitecturally compatible with the existing building or structure. <br /> <br />(2) Landscaping: <br /> <br />a. The qum~fit_fi, density and quality, of the plant material is increased <br /> apgraded; and , <br />b. The chea_~ges reflect.a substantial improvement.of the plan. . . <br /> <br />Any applicant who is dissatisfied with the approval by the community development director may <br />request that the matter be referred to the board for resolution at its next regularly meeting. <br />(Ord, No. 86.52, § I, 7-24-86; Ord. No, 94.t7, 6~9-94) <br /> <br />S,ec~ 1t~§, Appeal° <br /> <br /> (a) Th~ applicant for design review, or the community development director with the <br />consent of the city rnanage~; or any member of the city council, may appeal any decision of the <br />design review board to the city cotmcil by filing written notice of appeal and any applicable <br />appeal fee (See Appe~dix) with the c/ky clerk within ten (10) working days of the date of the <br />desigtx review bom'd% action, in accordance'with Rule 6 of Arizona Rules of Civil Procedure of <br />the State of Arizona~ Notice of such appeal and the date for its consideration by the city council <br />shall be published once, not less than .~;even (7) days prior to the council meeting at which such <br />appeal is to be hem'd. <br /> <br />11-6 <br /> <br /> <br />
