CASE REQUEST FOR A CONDITIONAL USE PERMIT TO EXCEED THE MAXIMUM SINGLE ACCESSORY STRUCTURE SIZE RESTRICTIONS; CASE OF STEPHEN AND BARBARA DVORAK By: Zoning Administrator Sylvia Frolik Background: On September 9, 1998, the City received an application from Stephen and Barbara Dvorak for a conditional use permit to exceed the maximum single accessory structure size restrictions on their property at 6641 157th Avenue N.W. The following items are enclosed for your information: a) b) c) d) Site location map Site Plan Proposed findings of fact Proposed conditional use permit Notification: State Statute requires notification of the public hearing to owners of property within 350 feet of the subject property; City Staff attempted to notify property owners within 500 feet. Observations: The subject property is .9 acres in size and is restricted to a total of 1,488 square feet of garage and accessory building space. In addition, there is an 624 square foot size restriction on any single accessory structure. The Dvorak's currently have a 528 square foot attached garage. They are proposing to construct a 936 square foot accessory building in which to store personal items. The addition of the proposed 936 square foot accessory building is within the parameters for total garage space allowed on the subject property, but it will exceed the maximum single building size by 304 square feet. The City has approved overages in building sizes in the past. Recommendation: City Staff'recommends approval of the request based on the fact that the Dvoraks have stated that the building will not be used for commercial purposes. Additionally, allowing a 300 square foot overage in single building size may be more aesthetically pleasing than requiring the property owner to use up the remaining 300 square feet in allowable garage space on a third garage or accessory building. 17'
