CASE <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO EXCEED THE MAXIM~ <br />SINGLE ACCESSORY STRUCTURE SIZE RESTRICTIONS; <br /> CASE OF SCOTT LEBAKKEN <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />On October 20, 1998, the City received an application fi:om Scott Lebakken for a conditional use <br />permit to exceed the maximum single accessory structure size restrictions on his property at <br />14100 Germanium Street N.W. The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Site Plan and letter of application <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff attempted to notify property owners within 350 feet of the <br />subject property of the request for a conditional use permit. <br /> <br />Observations: <br /> <br />The subject property is .9 acres in size and is restricted to a total of 1,488 square feet of garage <br />and accessory building space. In addition, there is an 624 square foot size restriction on any <br />single accessory structure. Scott currently has a 528 square foot attached garage. Mr. Lebakken <br />is proposing to construct a 960 square foot accessory building in which to store his personal <br />recreational equipment. However, City Code does allow residents to store their commercial <br />vehicles and equipment on their property as long as there are no outside employees coming to the <br />home. Therefore, the applicant or a subsequent property owner would be allowed to store <br />commercial equipment in the building under the current ordinance. <br /> <br />The addition o~ the proposed 960 square foot accessory building complies with the parameters <br />for total garage space allowed on the subject property, but it will exceed the maximum single <br />building size by 336 square feet. Mr. Lebakken states that in order to comply with City Code <br />single building size restrictions, he would have to build a 624 square foot detached garage and <br />increase the size of his attached garage by 336 square feet. If he puts an addition on his attached <br />garage, it will prohibit access to his detached garage. <br /> <br />The City has approved overages in building sizes in the past. <br /> <br /> <br />
