Councilmember adoption: introduced the following resolution and moved for its RESOLUTION NO. 98-11- A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT BASED ON FINDINGS OF FACT it AND DECLARING TERMS OF PERMIT FOR AN OVERAGE IN SINGLE ACCESSORY STRUCTURE SIZE RESTRICTIONS WltEREAS, the Ramsey City Council adopted Resolution No. 98-11- adopting Findings of Fact # for this use and herein approves the Conditional Use Permit subject to the following conditions. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On ,1998, a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") to Scott Lebakken ("Permittee") for an overage in single accessory structure size restrictions on the property generally known as 14100 Germanium Street N.W. and legally described as follows: Lot 4, Block 1, Flintwood Hills, Anoka County, Minnesota. ("Subject Property:") This permit is issued pursuant to Section 9.03.04 and 9.11.02 of the Ramsey City Code. The conditions of this permit are as follows: That this resolution shall allow for the construction of a 960 square foot accessory garage ("Structure") on the Subject Property in accordance with the site plan dated received by the City on October 20, 1998. That the Permittee shall obtain all necessary permits prior to commencing any construction of the Structure. o That the Structure shall be used for the storage of personal property and/or commercial vehicles and equipment belonging to the Applicant or any subsequent property owner, in accordance with City Code. However, no commercial or industrial activity involving employees that do not reside on the Subject Property shall be allowed in the Structure unless it is done so in accordance with the Ramsey City Code. That the driveway constructed to access the Structure shall maintain a three (3) foot setback from the south property line.
