Mr. Jankowski stated the drainage will go into the ponds and the ponds will be directed into the <br />River. <br /> <br />Mayor Gamec excused himself from the meeting at this point so Mayor Pro tern Zimmerman <br />chaired the meeting until his return. <br /> <br />Motion <br />Change <br />the TIF <br /> <br />by Councilmember Haas Steffen and seconded by Councilmember Beahen to approve <br />Order No. 2 for Improvement Project #98-18 in the amount of $9,200 with funding from <br />Account. <br /> <br />Motion carried. Voting Yes: Mayor Pro tem Zimmerman, Councilmembers Haas Steffen and <br />Beahen. Voting No: None. Absent: Mayor Gamec and Councilmember Beyer. <br /> <br />Motion by Councilmember Beahen and seconded by Councilmember Haas Steffen to approve <br />Change Order No. 1 for Division C of the t998 Street Maintenance Program in the amount of <br />$14,100 with $6,660 charged to the MSA project. <br /> <br />Motion carried. Voting Yes: Mayor Pro tem Zimmerman, Councilmembers Beahen and Haas <br />Steffen. Voting No: None. Absent: Mayoi~ Gamec and Councilmember Beyer. <br /> <br />Case #4: Authorization to Execute an Easement Agreement from T.H. #I0 at the Site of <br /> the Anoka West Pet Hospital, Inc. <br /> <br />City Administrator Norman stated the City has been working with Dolphin Real Estate <br />Partnership to allow the construction of a new Burger King located at the intersection of T.H. <br />/il0 and Ramsey Boulevard. As part of that process, MnDOT has requested that the proposed <br />Burger King operation not add a separate access to T.H. #10 but to develop an agreement with <br />the pet hospital for access utilization of both entities. As part of the negotiations, MnDOT has <br />agreed to pay up to $40,000 for the improvements for a single access of the two entities. To <br />complete the understanding, the City has been asked to develop the proposed easement <br />agreement and administer all the elements of the access easement agreement. Mr. Norman <br />advised that City Attorney Goodrich has drafled a proposed easement agreement for all the <br />parties. The agreement basically would allow the utilization of the current pet hospital access for <br />both the pet hospital and Burger King as access to T.H. #t0. MnDOT would provide up to <br />$40,000 for the improvements of said access and the City would provide the administration and <br />accounting of the disbursements for the improvements. Staff recommends that the Council <br />authorize execution of the agreement between Anoka West Pet Hospital, MnDOT, and Dolphin <br />Real Estate Parmership. <br /> <br />Councilmember Haas Steffen inquired regarding to the Comprehensive Plan and service roads <br />that may be necessary on T.H. #10. She noted this is a very narrow parcel of land and it may be <br />impossible to locate a service road behind it. <br /> <br />Mayor Pro tem Zimmerman asked if the suggestion is for the City Planner to review this issue. <br /> <br />City Council/October 13, 1998 <br /> Page 16 of 22 <br /> <br /> <br />
