CASE <br /> <br /> REQUEST FOR A CONDITIONAL USE PERMIT; <br />CASE OF ANOKA CONGREGATION OF JEHOVAH WITNESSES <br />By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />The City has received an application for a conditional use permit from the Congregation of <br />Jehovah Witnesses to expand their church facility at 13751 Dolomite Street N.W. to include a <br />utility shed for equipment storage purposes. The following items are enclosed for your <br />information: <br /> <br />a) <br />b) <br /> <br />d) <br /> <br />Site location map <br />Site plan <br />Proposed findings of fact <br />Proposed conditional use permit <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff attempted to notify property owners within 350 feet of the <br />Subject Property of the request for a conditional use permit. <br /> <br />Observations: <br /> <br />In 1978, the City Council issued a conditional use permit to the Jehovah Witness Congregation <br />to establish a church in the commercial district. Now the church has a need to construct an <br />accessory structure in which to store their lawn equipment. Expansion of a conditional use to <br />include another structure requires a Conditional Use Permit. <br /> <br />The addition of the 192 square foot storage shed to the site does not conflict with the 35% lot <br />coverage restriction. The applicants are proposing to side the storage shed with vinyl siding. <br />Code requires all natural or prefabricated stone finishes on structures in the commercial district <br />unless otherwise approved by the City Council. The City Council has previously approved <br />deviating from the stone fmish on accessory buildings in the commercial districts. <br /> <br />The site plan shows that the shed is proposed to be 23 feet from the rear or south property line <br />and it is not clear how far it will be from Dolomite Street or the west property line. Staff is <br />recommending that the conditional use permit require the structure be sited on the property in <br />accordance with the B-3 Highway Business District regulations. This would require the shed to <br />be located 35 feet from the south property line and no closer to Dolomite Street than the principal <br />building (church). <br /> <br /> <br />
