16. <br /> <br />That the City recently granted a conditional use permit for the construction of an accessory <br />structure prior to a principal building on a lot that is also owned by the adjacent homeowner; <br />this permit was granted to replace a pre-existing nonconforming building damaged by <br />summer storms and the placement of same was such that a principal building or dwelling <br />could be developed on the property in accordance with current structure setback standards in <br />the future. <br /> <br />17. <br /> <br />That since the pubic hearing notice was published for the Applicant's conditional use permit <br />application, Staff has received complaints from neighboring residents that the Applicant's <br />commercial operation has escalated to include outside employees. <br /> <br />18. That Section 9.11.10 of the Ramsey City Code provides the opportunity for residents to store <br /> commercial vehicles and equipment on residentially zoned property if they can park it <br /> indoors or screen it to a degree of 75% from the public road and neighboring properties; this <br /> provision does not grant residents the right to establish a commercial operation with outside <br /> employees on their homestead. <br /> <br />19. That the proposed use will/will not adversely impact traffic in the area. <br /> <br />20. That the proposed use will/will not be unduly dangerous or otherwise detrimental to persons <br /> residing or working in the vicinity of the use or to the public welfare. <br /> <br />21. That the proposed use will/will not substantially adversely impair the use, enjoyment, or <br /> market value of any surrounding property. <br /> <br />22. That the proposed use will/will not be hazardous or disturbing to existing or future <br /> neighboring uses. <br /> <br />23. That the proposed use will/will not be served adequately by public facilities and services such <br /> as highways and streets. <br /> <br />24. <br /> <br />That the proposed use will/will not create excessive additional requirements at public cost for <br />public facilities and services, and it will/will not be detrimental to the economic welfare of <br />the community. <br /> <br />25. <br /> <br />That the proposed use will/will not involve activities and uses that will be detrimental to any <br />persons, property, or the general welfare by reason of excessive production of traffic, noise, <br />smoke, fumes, glare, or odors. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br /> , and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />RESOLUTION #98-06-131 <br /> page 3 of 3 <br /> <br /> <br />
