CITY OF RAMSEY <br /> ANOKA COUNTY, MINNESOTA <br />DEVELOPMENT AGREEMENT - BURY AND CARLSON ADDITION <br /> <br />THIS AGREEMENT, made and entered into by and between the CITY OF RAMSEY, a <br />municipal corporation of the State of Minnesota (the "CITY"), and BURY AND CARLSON, <br />INC., a Minnesota Corporation, whose address is 201 West 121st Street, Burnsville, Minnesota <br />55337 ("the DEVELOPER"). <br /> <br />WITNESSETH: <br /> <br /> WItEREAS, the DEVELOPER is the fee owner of the following described property <br />situated in the CITY OF RAMSEY, County of Anoka, State of Minnesota, and legally described <br />as follows: <br /> <br />Bury and Carlson Addition, Anoka County, Minnesota, <br /> <br />the "Subject Property"; and <br /> <br /> WltEREAS, on August 25, 1992, pursuant to Resolution #92-08-200, the CITY <br />approved the final plat of the Subject Property which plat is known as BURY AND CARLSON <br />ADDITION (the "Plat") contingent on certain requirements, including DEVELOPER and <br />CITY entering into this contract; and <br /> <br /> WHEREAS, the Plat consists of one (1) lot and one (1) outlot totalling approximately <br />twenty and one-half (20.59) acres; and <br /> <br /> WltEREAS, approval of the Final Plat is given pursuant to the City's Subdivision Code <br />Section 9.50.05 (Subd. 2) entitled "Division or Consolidation of Unplatted Lots". <br /> <br /> WHEREAS, no expenditure of CITY funds will be made until City Code escrow <br />requirements have been fulfilled by the DEVELOPER. <br /> <br />NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />IMPROVEMENTS <br /> <br />1. Access to Lots. The Plat shall have access onto Jaspar Street N.W. <br /> <br />o <br /> <br />Extension of 143rd Avenue N.W. The DEVELOPER shall provide a thirty-three <br />foot outlot along the northern boundary of the plat. This outlot shall preserve a corridor for <br />the possible future extension of 143rd Avenue N.W. Upon the CITY'S request, the fee <br />title owner of the subject outlot shall deed the outlot to the CITY, at no expense to the <br />CITY. <br /> <br />Access To Foster Cemetery, Prior to recording the Plat, the DEVELOPER shall <br />provide the CITY with two separate easements, in recordable form, granting the CITY <br />public access to Foster Cemetery from 143rd Avenue N.W. through Outlot A and south <br />along the eastern boundary of the Plat to the cemetery. <br /> <br />Drainage and Utility Easements. Drainage and utility easements shall be dedicated to <br />the CITY as shown on the Final Plat. <br /> <br />Site Grading. The DEVELOPER shall be responsible at its expense for grading the <br />site in accordance with Sheet 2 of 5 prepared by Dennis Griswold, registered landscape <br />architect, and dated 6/16/92, Revision date 7/30/92. <br /> <br /> <br />
