CASE <br />REQUEST FOR A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE <br />NEARER THE FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE; <br /> CASE OF RICHARD MITCHELL <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />City Code states that accessory structures shall not b3~ constructed nearer the front property line <br />than the principal structure. Richard Mitchell is requesting a variance to construct an accessory <br />garage nearer the front property line than the principal structure at 6415 172nd Lane NW. The <br />parcel is approximately 2.7 acres in size, and the house is located approximately 155 feet from <br />the front property line. He is proposing to construct a garage which will be approximately 90 <br />feet from the front property line. The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site plan <br />c) Proposed Findings of Fact <br />d) Proposed Variance <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff attempted to notify property owners within 350 feet of the <br />subj~:.ct property of the request for a variance. <br /> <br />Observations: <br /> <br />The site plan submitted and an on-site inspection reveal that declines in topography, substantial <br />mature tree growth, and drainfield and alternate drainfield locations prohibit construction of an <br />accessory garage in the side or rear yard. <br /> <br />Staff Recommendation: <br /> <br />City Staff recommends approval of the request for a variance. <br /> <br />Board Action: <br /> <br />Motion to adopt Resolution #98-06- <br />Richard Mitchell's request for a variance. <br /> <br />adopting Findings of Fact # <br /> <br />relating to <br /> <br />Motion to approve/deny the request for a variance from Richard Mitchell to construct an <br />accessory structure nearer the front property line than the principal structure on the property <br />known as 6415 172nd Lane NW, and adopt Resolution #98-06- ~ declaring terms of the <br />variance. <br /> <br />Reviewed By: City Attorney <br />B/A: 06/02/98 <br /> <br /> <br />
