Board Member introduced the following resolution and moved for its adoption: RESOLUTION #98-09- A RESOLUTION ADOPTING FINDINGS OF FACT # RELATING TO A REQUEST FOR A VARIANCE TO THE HEIGHT RESTRICTIONS IN A MULTIPLE RESIDENTIAL DISTRICT WHEREAS, the City of Ramsey, hereinafter referred to as "Applicant", has requested a Board of Adjustment variance from structure height restrictions to develop a senior housing facility on the property legally described as follows: That part of the Northeast Quarter of the Southwest Quarter of Section 25, Township 32, Range 25, Anoka County, Minnesota, lying southwesterly of the southwesterly right-of-way line of County State Highway No. 5 and lying easterly of the easterly right-of-way line of Dysprosium Street and lying westerly of the westerly right-of-way line of Trunk Highway No. 47, subject to easements of record. (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: That the Board of Adjustment conducted a public heating pursuant to Section 9.03.05 of the Ramsey City Code on September 1, 1998 and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. o That on August 25, 1998, the Ramsey City Council introduced an ordinance to rezone the Subject Property from B-I Business to Multiple Residential; the ordinance is scheduled for final adoption on September 8, 1998. 3. That the surrounding property is.zoned B-1 Business and Planned Unit Development. That the City, in conjunction with the Anoka County Housing and Redevelopment Authority, is proposing to develop a 3-story apartment building for senior persons (55 years and older) on the Subject Property. 5. That the Multiple Residential District regulations restrict structure heights to 35 feet. 6. That Section 9.02 of the Ramsey City Code defines 'Building Height' as the distance measured from the mean ground level to the uppermost point of the roof.
