CASE <br /> <br />REQUEST FOR A VARIANCE TO ENLARGE A NON-CONFORMING ACCESSORY <br />STRUCTURE LOCATED NEARER THE FRONT PROPERTY LINE <br /> THAN THE PRINCIPAL STRUCTURE; <br /> CASE OF LAWRENCE AND SHERRIE THOLE <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />City Code states that accessory structures shall not be constructed nearer the front property line <br />than the principal structure. Lawrence and Sherrie Thole assumed ownership of 17440 Gibbon <br />Street N.W. and at the time, there existed a detached garage on the property that was located <br />nearer the front property line than the home. This past year the garage incurred some storm <br />damage and the Thole's decided to enlarge the garage when they make the repairs. In reviewing <br />the City records, a variance was never issued to this address for the garage (a variance was issued <br />for the barn in 1986). Therefore, the garage is'considered non-conforming and a variance for the <br />location is required to enlarge the structure. <br /> <br />The parcel is approximately 3.3 acres in size, and the house is located approximately 222 feet <br />from the front property line. The shortest distance between the non-conforming garage and <br />property line is 110 feet, however, that will lessen to about 90' because the 20' addition is <br />towards the street. The size of garage proposed is in conformance with City Code. The <br />following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site plan <br />c) Proposed Findings of Fact <br />d) Proposed Variance <br /> <br />Notification: <br /> <br />State Statute requires notification of the hearing to owners of property within 350 feet of the <br />subject property. Staff attempted to notify property owners within 500 feet of the subject <br />property of the request for a variance. <br /> <br />Observations: <br /> <br />A visit to the site revealed that there are a substantial amount of ponds and wetlands on the site. <br />In addition, the home is oriented towards the south property line rather than Gibbon Street. The <br />buildable sites remaining on the property are south and west of the house. The south yard is <br />virtually the front yard and the bedrooms are located on the west side of the house. Correct <br />relocattion of the garage to the south or west yard is not logical with the layout of the property. <br /> <br /> <br />
