o <br /> <br />10. <br /> <br />i1. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />I5. <br /> <br />16. <br /> <br />17. <br /> <br />18. <br /> <br />19. <br /> <br />20. <br /> <br />That the Applicants are proposing to repair some storm damage to the non-conforming <br />garage, and in the process are preparing to enlarge the garage by approximately 480 square <br />feet. <br /> <br />That enlarging the garage in its current non-conforming location will require prior acquisition <br />of a variance. <br /> <br />That there are special conditions applying to the Subject Property that do not generally apply <br />to other properties in the district; namely a significant portion of the Subject Property <br />contains ponds and wetlands, and that the dwelling is oriented towards the south property line <br />versus the frontage on Gibbon Street. <br /> <br />That there is some buildable land south and west of the house, but because of the house's <br />orientation towards the south, the south yard is front yard and the west yard is on the <br />bedroom side of the home; these yards contain the septic tank, drainfield and well; and <br />neither of these yards make logical locations for a garage. The remainder of the Subject <br />Property that would be considered behind the home is wetland. <br /> <br />That the special conditions do not result from the actions of the Applicant; the Subject <br />Property was developed with the home and non-conforming garage when purchased by the <br />Applicants. <br /> <br />That similar variances have been granted in the R-1 Rural Residential District in the City of <br />Ramsey. <br /> <br />That the variance requested is the minimum variance which would alleviate the hardship. <br /> <br />That literal interpretation of the provisions of City Code will/will not deprive the Applicant <br />of rights commonly enjoyed by other properties in the same district. <br /> <br />That if granted, the variance will]will not permit a use that is prohibited in the R-1 Rural <br />Residential District. <br /> <br />That if granted, the variance will not impair an adequate supply of light and air to adjacent <br />property. <br /> <br />That if granted, the variance will/will not Unreasonably increase the congestion in the public <br />street. <br /> <br />That if granted, the variance will/will not increase the danger of fire or endanger the public <br />safety. <br /> <br />That if granted, the variance will]will not unreasonably diminish property values in the <br />neighborhood. <br /> <br />RESOLUTION #98-05-070 <br /> Page 2 of 3 <br /> <br /> <br />
