CASE <br /> <br />REQUEST FOR A VARIANCE TO CONSTRUCT AN ACCESSORY STRUCTURE <br />NEARER THE FRONT PROPERTY LINE THAN THE PRINCIPAL STRUCTURE; <br />CASE OF TIMOTHY AND ANITA KASTER <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />City Code states that accessory structures shall not be constructed nearer the front property line <br />than the principal structure. Timothy Kaster is requesting a variance to construct a 12' x 16' <br />utility shed nearer the front property line than the principal structure at 17765 Tonto Street N.W. <br />The parcel is approximately 1 acre in size, and the house is located approximately 60 feet from <br />the front property line. Mr. Kaster is proposing to construct the utility shed approximately 35 <br />feet from the front property line. The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site plan <br />c) Proposed Findings of Fact <br />d) Proposed Variance <br /> <br />Notification: <br /> <br />In accordance with State Statute, Staff attempted to notify property owners within 350 feet of the <br />subject property of the request for a variance. <br /> <br />Observations: <br /> <br />The site plan submitted and an on-site inspection reveal that sharp declines in topography, <br />mature tree growth, and drainfield and alternate drainfield locations prohibit construction of an <br />accessory building in the side or rear yard. <br /> <br />Staff Recommendation: <br /> <br />City Staff recommends approval of the request for a variance. <br /> <br />Board Action: <br /> <br />Motion to adopt Resolution #98-11- <br />Timothy Kaster's request for a variance. <br /> <br />__ adopting Findings of Fact # <br /> <br />relating to <br /> <br /> <br />
