BERGLUND AND <br /> JUNIPER RIDGE PARTNERSHIP <br /> By: Steve Jankowski, City Engineer <br /> <br />Background: <br /> <br />Rum Acre Estate was platted in I974, however, Lot 1 Block 5 of the subdivision was <br />encumbered with a temporary drainage easement until an outlet for the drainage no longer <br />required that the lot itself be utilized as a reservoir for the drainage of the surrounding area. <br />An outlet for this lot was constructed in 1990 as part of the utility work for the Juniper <br />Woods Development. The lot owner has taken steps to remove the temporary drainage <br />easement on the property, and on November 26, 1996 the City Council agreed to declare <br />the condition of the temporary drainage easement met contingent upon compliance of <br />certain requirements. · - · <br /> <br />In anticipation of this easement vacation, the owner of the lot caused the placement of <br />approximately four feet of imported fill material during the spring and summer of 1996, to <br />establish a house pad. The volume of this Fill and the fact that it was imported required that <br />a mining and grading conditional use permit should have been obtained. <br /> <br />The following items are enclosed for your information: <br /> <br />A. Site location map <br />B. Lot survey <br />C. Draft public hearing and planning commission meeting minutes dated Dec. 3, <br /> 1996. <br />D. Proposed finding of fact <br />E. Proposed conditional use permit <br /> <br />Observation: <br /> <br />This land parcel was intended to be a site for a single family home over twenty years ago. <br />The placement of the fill and grading in conformance with the Certificate of Survey will <br />result in a single family home site which will reasonably conform to the neighborhood. <br /> <br />Recommendation: <br /> <br />Staff recommends the following conditions should be included in the mining and grading <br />permit: <br /> <br />The applicant shall pay the cost associated with the patching of the pavement of <br />Juniper Ridge Drive, where the pavement was broken up by the tractor hauling <br />material to the site. This cost shall be agreed to be $250.00. <br /> <br />2. The applicant agrees to grade the lot in accordance with the Certificate of Survey, <br /> prepared by Charles F. Anderson and dated November 15, 1996. <br /> <br />3. The applicant agrees to establish turf over all disturbed area by seeding or sod <br /> before June 1, 1997. <br /> <br /> <br />
