7.2 <br /> <br />SANCTION OF TIlE CABLE COMPANY <br /> <br />Creighton requested that the Commission referred to a packet of letters <br />and memo's received in the packet which was approximately 18 pages <br />in length. <br /> <br />Creighton informed the Commission that the sanction issues have <br />been brought before the Commission after review by all of the <br />Meredith Administrators that Creighton represents from the various <br />commissions. <br /> <br />The memorandum laid out the back ground and then the Franchise <br />laid out the provisions Creighton will discuss with Commission <br />Members. <br /> <br />Crieghton stated that the issue has to due with the closing of the sale of <br />U.S. West in relationship to the various communications and the <br />relationship to the original memorandum. <br /> <br />On October 18, 1996 Mr. Gibbs sent a notification that the FCC Bureau <br />had granted the petition for relief, therefor the satisfaction of condition <br />under #2 of our resolution which requires that the company review ail <br />necessary waivers from the FCC had been met. <br /> <br />Creighton then referred to a letter that was sent to Mr. Gibbs. This <br />letter was dated October 28, 1996. <br /> <br />The letter stated that In response to your letters of October 18,'1996 and <br />October 25, 1996, and as you have been previously notified verbally, <br />please be acivised that we have been instructed to appeal the Cable <br />Services Bureau order regarding the obove-refereneed matter. AS you <br />know, .c.o_ndition number 2 of the respective consent resolutions <br />requires that "ail necessary federal, state and local government waivers, <br />authorizatio.ns, or approvals" be obtained. Therefore, the <br />determination as to your receipt of "all necessary"_approvals has not <br />been finalized, resulting in all conditions of the consent resolution~ <br />notbeina satisfied. <br /> <br />Crieghton stated that once the Commission appealed the Order of the <br />Bureau it wasn't a final Order in his opinion and the FCC could infect <br />reverse its decision. Tom stated that in his opinion "all necessary" <br />meant that you had a final order from the FCC. <br /> <br />The letter then when on the state Until finalization of all necessary <br />approvals, you are hereby notified that any attempt to finalize the sale <br />of the above named continental systems to U.S. West would be done in <br />violation of the consent resolution.
