WHE~EAB, the City finds it necessary to add capacity to its ~xisting m~nicipal water utility system; and WHEREA~, a new water well and.well house (collectively the "Public Improvement") is necessary to accomplish this additional capacity requirement; and WHEREA~, the City finds it necessary to acquire fee title to certain real property in order to provide property for the construction of the water well and well house; and WHEREAS, the City has authority to acquire the real property for the Public Improvement by eminent domain pursuant to Minn. Stat. Chapter 117; and WHEREAS, the City has the right to acquire the real property prior to the filing of an award by the Court appointed co~issioners, pursuant to Minn. REAL PROPERTY DESCRIPTION The South 100.00 feet of the West 100.00 of the East 750.00 of the Northeast Quarter of the Northeast Quarter of Section 28, Township 32, Range 25, Anoka County, Minnesota, NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY RAM~EY, ANOKA COUNTY, STATE OF MINNESOTA, as That the city Administrator is hereby directed to acquire the real property as described above in accordance with Minnesota Statutes. The City Administrator is authorized to negotiate and represent the City of Ramsey in all proceedings. That if the real property as described above cannot be acquired by direct negotiation, it shall be acquired by eminent domain.
