The well site is currently owned by Jack Menkveld. We had difficulty
getting in much with Mr. Menkvetd as he goes south for the winter. However, now we need to
assure that this acquisition will occur and we are asking for Council to adopt a resolution
authorizing the initiation of condemnation proceedings and authorizing continued negotiations to
purchase the property plus take the steps necessary to prepare for condemnation should
negotiations fail.

Councilmember Haas Steffen asked about having two new water towers.

Mr. Schroeder stated this is the west well field. There will be several in this area eventually and a
water tower will be constructed in 1999.

Councilmember Haas Steffen suggested revisiting the construction date for the water tower.

Motion by Councilmember Zimmerman and seconded by Councilmember Beahen to adopt
Resolution ~97-02-046 authorizing the beginning of the condemnation proceedings for the
property required for Well #3 and Well House #2 for the Municipal Water System.

Motion carried. At the end of the season, he plans to break all the activity down for City Council so you know
the types of concerns we get. He added that they would try to identify the following: types of
violations, time frames (weekends, after school, after hours specified in City Ordinance, etc.)
drivers (residents, people from out of town, ages, proximity to operator's residence) MUSA
versus Rural violations, safety versus annoyance type violations, trespass/property damage versus
annoyance type violations. He presented a map showing the locations of all the concerns and the
locations of the citations.

Councilmember Haas Steffen inquired if the complaints are spread out City-wide.

Sergeant Gustafson replied that the MUSA outweighs the number of complaints. He added that
with the end of season report, Council and staff should be able to determine what they want to do
for the next season.

City Council/February 25, 1997

I
I
I
I
I
I
i
I
I
I
I
I
i
I
I
I
I
I
I
