I ! I I deprive the petitioner of the reasonable use of petitioner's land. That the exception is necessary for the preservation and enjoyment of a substantial property right of the petitioner. That the granting of the exception will not be detrimental to the public welfare or injurious to other property in the area in which the property is situated. That the proposed exception will be harmonious with and in accordance with the specific objectives of the city's existing Comprehensive Plan and will not adversely affect the planning process for adoption of amendments to the Comprehensive Plan above described. That the proposed use/subdivision will be consistent with the intent and purpose of this Ordinance. SECTION 7. TERM, The term of this Ordinance shall be 180 days commencing with its effective date. SECTION 8. VIOLATION. The city may enforce any provision of this Ordinance by mandamus injunction or any other appropriate civil remedy in any Court of competent jurisdiction. SECTION 9. EFFECTIVE DATE. This ordinance becomes effective upon its passage and thirty (30) days after its publication according to law, subject to Charter Provision, Section 5.04.
