property was properly zoned for the Apple Ridge subdivision. While Minnesota <br />law does not allow developers to rely on mere verbal representations regarding <br />zoning, Frank's Nursery Sales v. City of Rosevitle, 295 N.W.2d 604, 607 (Minn. 1980), <br />land owners may rely on official city action involving zoning. The City has <br />maintained its Official Zoning Map pursuant to City Ord. 9.20.04. The pertinent part <br />of the ordinance provides: <br /> <br /> The boundaries of the zoning districts and development areas are delineated <br /> on the Official Zoning Map which is hereby adopted by reference and declared <br /> to be a part of this chapter. Such map shall be on permanent file and <br /> available for public inspection in City Hall. It shall be the responsibility of the <br /> zoning administrator to maintain and keep the map up to date and to record <br /> each amendment hereto within 30 days after official publication of the <br /> ordinance adopting the amendment. <br /> <br /> III. The City of Ramsey has an Enforceable Agreement with Mr. Barthold <br /> Regarding Development of the Property. <br /> <br /> As the City of Ramsey steadily became more urban over the past 10 years, City <br />officials properly evaluated ways to assist property owners in the transition. It <br />became clear that a hog farming operation would not continue to be 'the optimal use <br />of Mr. Barthold's property as the neighborhood became more residential. As a <br />result, the City negotiated an agreement with Mr. Barthold whereby he would stop <br />raising hogs in exchange for the inclusion of the property within the MUSA line, <br />allowing him urban development. Mr. Barthold stopped the hog farming operation <br />and the property was included within the MUSA line in the City's 1994 <br />Comprehensive Plan Amendment. <br /> <br />8 <br /> <br /> <br />
