No occupancy permit for any lot in the Plat shall <br />be issued until: (a) vehicular access to the lot is provided including the installation of <br />Class V material on all streets in the Plat; (b) site plan approval is granted by the CITY <br />and any additional expense incurred in giving site plan approval has been reimbursed to <br />the CITY; (c) a Certificate of Survey, including that information required by the CITY, <br />been supplied to the City Building Official; (d) a tree planting has been. accomplished in <br />accordance with Item #15 of this Agreement; and (e) all the financial guarantees required <br />by the CITY have been satisfied. <br /> <br />IV. PARK DEDICATION <br /> <br />Cash and Trail Development. The Plat is located in the Marble Park District. Park <br />dedication requirements shall be satisfied by a cash payment in the amount of $33,250.00 <br />(38 units x $875.00 per unit). <br /> <br />V. TRANSPORTATION AND LANDSCAPING <br /> <br />Transportation Impact Fee. The CITY has enacted a Transportation Impact Fee in the <br />amount of Five Hundred Dollars ($500.00) per lot. The amount of Transportation Impact <br />Fee due on the Plat is Nineteen Thousand Dollars ($19,000.00). The DEVELOPER has <br />the option to either: (a) Pay the entire amount due prior to the CITY releasing the Plat <br />for recording at the County; or Co) Pay fifty percent of the Transportation Impact Fee <br />($9,500.00) prior to the CITY releasing the Plat for recording and divert the remaining <br />$9,500.00 due as an additional $250.00 fee on each building permit issued in the Plat. <br />The amount of the DEVELOPER'S share of the Transportation Impact Fee due shall be <br />credited for construction of the transportational trail described in ]item #16 of this <br />Agreement in the amount of__ Thousand Dollars and no cents ($ ) <br />(1,022 lineal feet x __ per foot). The minimum remaining amount of Transportation <br />Impact Fees due from the DEVELOPER is Thousand Dollars and no cents <br />($ ), if the other 50%, or $9,50,0.00, is to be collected on building permit fees. <br /> <br />Transportation Trail. The DEVELOPER shall construct and pave in accordance with <br />CITY standards an eight (8) foot wide bituminous trail not to exceed 5% in grade, <br />parallel to C.S.A.H. #56 from 149th Avenue NW, south to C.S.A.H. #116. There shall be <br />a minimum of ten (10) feet between the edge of the trail pavement and the adjacent <br />property lines. The DEVELOPER shall provide approved turf establishment in <br />conjunction with trail construction within the subject Plat. The construction of this <br />transportational trail shall be credited against the Transportation Impact Fee due on the <br />Plat in the amount of Thousand Dollars and no cents (1,022 lineal feet x <br />~ per foot). <br /> <br />Tree and Sod Planting Plan. Sodded boulevards are a requirement for each lot in the Plat <br />prior to issuance of a Certificate of Occupancy. In accordance with the City Code and the <br /> <br /> <br />
