Councilmember Hardin introduced the following resolution and moved for its adoption: RESOLUTION #94.04-076 A RESOLUTION ADOPTING FINDING REQUEST FROM SIDNEY NYHUSMOEN TO MINE AND EXPORTS SOILS OF FACT #0360 RELATING TO A FOR A CONDITIONAL USE PERMIT WHEREAS, the City of Ramsey received an application from Sidney Nyhusmoen for a conditional use permit to mine and export soils from the property legally described as follows: Lot I, Block 1, HY-10 RAMSEY 4TH ADDITION, Anoka County, Minnesota. (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: 7 8. 9. 10. 11. 12. That on March 15, 1994, Sidney Nyhusmoen, herein after referred to as "Applicant", has properly applied for a conditional use permit to mine and export soils in the I-1 Industrial District. 13. That the applicant appeared before the Ramsey Planning and Zoning Commission for a public hearing pursuant to Section 9.03.04 of the City Code on April 5, 1994, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. That the subject property is located in the Industrial District, and is approximately 4.4 acres in size. That mining is not a permitted use in the Industrial District. That the Subject Property is surrounded by Industrial zoning. That the Applicant is proposing to strip the topsoil on the Subject Property, export approximately 17,430 cubic yards of material, and replace the topsoil. That no fill materials are proposed to be imported to the site. That no blasting will be employed in the 3-fining activity. That no excavation will take place within the road r/ght-of-way. That the existing drainage patterns will not be substantially altered by the proposed grading plan. That there are other similar conditional use permits that have been approved by the City. That the mining operation will increase the traffic to the subject property and surrounding area. That the proposed use will not be 'unduly dangerous or otherwise detrimental to persons residing or working in the vicinity of the use or to the public welfare. I I I I I I I I
