Councilmember introduced the following resolution and moved for its adoption: RESOLUTION NO. 97-03- A RESOLUTION DECLARING TERMS OF CONDITIONAL USE PERMIT, BASED ON FINDINGS OF FACT NO. , FOR MINING OPERATIONS ON PIN NO. 29-32-25- 11-0009. WHEREAS, the Ramsey City Council adopted Resolution No. 97-03- regarding Findings of Fact No.~ for this use and herein approves the Conditional Use Permit subject to the following conditions. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On , 1997, a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") to Sidney Nyhusmoen ("Permit Holder") for mining operations on the property legally described as follows: Lot 1, Block I, HY-10 RAMSEY 4TH ADDITION, Anoka County, Minnesota. This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The conditions of this permit are as follows: 1. This permit shall expire on May 1, 2000. All equipment used for mining operations shall be maintained and operated in such a manner to minimize noise, dust, and vibrations adversely affecting surrounding properties. Ail equipment shall be kept in good repair. Abandoned equipment and rubbish shall be removed from the worksite regularly. All worksites shall be properly safeguard, ed to prevent the general public from depositing garbage or other refuse on the worksite. ', Existing tree and groundcover shall be preserved to the extent feasible. Mining operations shall be conducted in such a manner to minimize interference with the surface water drainage outside the boundaries of the operation. No mining operations shall occur at below an elevation of 6 feet above the elevation of the water table on the worksite. Fencing may be ordered by the City Council or City Engineer anytime the permit is in force and shall be installed within 24 hours of written notice. I I I ! I I I I I I I I I I I I I I
