The maximum noise level at the perimeter of the worksite shall be within the limits set by the Minnesota Pollution Control Agency and the Environmental Protection Agency of the United States. Ail mining operations shall be conducted in accordance with the grading plan dated received by the City on March I5, 1994. No more than one (1) acre of disturbed area shall be permitted at any time. Continuation of mining shall require finished grade areas to be restored with six (6) inches of topsoil, seed and disc anchored mulch. Ail costs incurred by the City in executing and administering this permit shall be the responsibility of the permit holder. The permit holder shall maintain a minimum Five Hundred Dollar ($500.00) balance in an escrow account with the City. This escrow shall be used to reimburse the City for expenses incurred in the administration of this permit. At the time the mining operation and site restoration are completed to the satisfaction of the City, the balance of the escrow shall be returned to the Permit Holder. Only State, County and City streets constructed to 9 ton standard shall be used as haul roads. The only City streets designated as haul roads for the operation shall be Ferret Street N.W. north of 147th Avenue N.W. and 147th Avenue N.W. between Ferret Street N.W. and Armstrong Blvd. N.W. The Permit Holder shall provide access from the site to the City street at a single point and a 50 foot length of crushed gravel shall be placed from this point into the site to minimize tracking dirt residue onto the City streets. All mining operations shall be conducted between 6:30 a.m. and 8 p.m. on weekdays only unless otherwise specifically approved by the City Administrator and/or his designee. The amount of dust or other particulate matter caused by the mining operation shall not exceed the standards established by the Minnesota Pollution Control Agency. No operation shall be allowed when wind gust exceed 30 miles per hour. All operations shall comply with all applicable Minnesota Pollution Control Agency regulations and Federal and Environmental Protection Agency regulations for the protection of water quality. All haul roads are subject to the ~pproval of the City Engineer. While hauling operations are in progress, the permit holder shall maintain the haul road in a condition satisfactory to the City Engineer. When hauling operations are completed, the permit holder shall either restore that haul road to a condition at least equal to that which existed at the time the hauling operations were started, or compensate the local road authority in an amount satisfactory to that road authority and concurred in by the City Engineer for the restoration of that haul road. The City Engineer will then accept such restoration or concur in such financial settlement for the restoration of the haul road in writing and such I I I I I I I I I
