I I PA~E Motion by Commissioner Johns and seconded by Commissioner Ostmm to recormnend City Council require $70,875 in park dedication and that the developer provide for a private tot lot space and connection to the City's County Road #57 trail. Motion Carried. Voting Yes: Chairperson Cook, Commissioners Johns, Ostmm, Asfahl, Droegemueller, LaMere, Kolfe, and Skinner. Voting No: None. Absent: None. Case #4: Approve/Recommend Ordir~ance Language for Communication 'rowers Kecent advances in wireless communications technology have resulted in a new generation of cellular conunnn~cations services. These new services will likely require numerous antenna locations throughout the Twin Cities area. Secedon 704 of the Telecommunications Kefo~ Act prohibits cities from restricting the installation, maintenance ro use of antennas. The Act does, however, permit cities to establish regulatory controls concerning placement of towers. At it',; February 7, 1997 Planning Commission meeting, it was determined that the Park and Recreation Commission should have the opportunity to decide which, if any, City parks are suitable for the placement of towers and antennas. These tower would provide additional revenue to the Park Improvement Fund. Commissioner Ostrum commented the loc~.tion of a potential amenna should be proposed by a developer accordingly. Chair Cook added requests should be considered on a ease-by-case basis. In response to Chair Cook, the City has already been approached which has lead to discussion of an ordinance adoption. Commissioner Droegemueller interjected a potential tower/antenna should not be placed in a park if there's not already something in place (i.e. water tower, light standards) so as to not disturb aesthetics of the park. Chair Cook indicated a desire to see placement in parks avoided at all costs. Commissioner Rolfe responded the Commission could consider placing towers/antennas in an unusable portion of the park (i.e. wetlands). Commissioner Ostmm added this would provide alternative generation of park development monies for the Commission. Motion by Commi~oner Ostmm and seconded by Commissioner Rolfe to recommend City Council approve language of the tower ordinance as it pertains to park issues and siting. Motion Carried. Voting Yes: Chairperson Cook, Commissioners Ostrum, R. olfe, Asfahl, Droegemueller, Johns, LaMere, and Skinner. Voting No: None..Absent: None. Case #5: Lawful Gambling Fund Revisions Mr. Boos explained updates had been made to the Lawful Gambling Fund Improvement Program as per the Commission's request. He added very few revisions were made. Commission members identified three additional corrections. On page two under "Eligibility, .... five" was changed to 'Tour" (located in the first sentence).
