2. That the exception is necessary for the preservation and enjoyment of a substantial property <br /> fight of the petitioner. <br /> <br />3. That the granting of the exception will not be detrimental to the public welfare or injurious to <br /> other property in the area in which the property is situated. <br /> <br />That the proposed exception will be harmonious with and in accordance with the specific <br />objectives of the City's existing Comprehensive Plan and will no adversely affect the <br />planning process for adoption of amendments to the Comprehensive Plan above described. <br /> <br />5. That the proposed use/subdivision will be consistent with the intent and purpose of this <br /> Ordinance. <br /> <br />SECTION 7. TERM. <br /> <br />The term of this Ordinance shall be 180 days commencing with its effective date. The term may <br />be extended after approval by the City Council for an additional period not exceeding 24 months, <br />as provided for in MSA §462.355, Subd. 4. <br /> <br />SECTION 8. PENALTIES. <br /> <br />Any person, firm, entity or corporation that subdivides or undertakes any development activity in <br />violation of the provisions of this Ordinance shall be guilty of a misdemeanor and shall be <br />subject to any additional legal or equitable remedies available to the City, <br /> <br />SECTION 9.
