The procedure by which a property owner may elect to remain on a functional private sewer and/or water system shall be as provided for in this Section. (a) Receipt of Notice. Upon receipt by the property owner of mailed notice advising that a public hearing is to be held relating to the assessment of costs of Public Improvement Project which project includes extending Urban Services (sewer and/or water) to a home owned by the property owner, the property owner who elects to remain on a functional private sewer and/or private water system shall: Certify to the City, on a recordable form provided by the City that the property oWner's existing home is serviced by a functional private sewer and/or private water system. (2) The above referenced written certification shall be filed with the City Clerk prior to the assessment hearing or presented to the presiding officer at the hearing. 4.70.08 EFFECTIVE DATE The effective date of this Ordinance is thirty (30) days after its passage and publication, subject to City Charter Section 5.07.
